Several members of Dinaulik clan from Kampung Nakias wanted to do blocking at the CPO mill of PT. Dongin Prabhawa with the aim to demand compensation

  1. On April 30, 2021, several members of Dinaulik clans came to the office of PT. Dongin Prabhawa to dispute the construction of the capacity extension of the CPO mill located in the former land of Dinaulik clan’s communal land which has been released and compensated by the company.
  2. So they asked for compensation as much as a part of the budget of extension construction of the CPO mill.
1. As a follow-up related to this issue, the consultation was held for 6 days between PT. Dongin Prabhawa and several members of Dinaulik clan to get the deal
2. Department of Public Relations of PT. Dongin Prabhawa explained that :
a. That land is the Cultivation Rights (HGU) area of PT. Dongin Prabhawa based on the document No : 85/HGU/BPN RI/2013 which was formerly the communal land of Dinaulik clan which had been released and compensated by the company.
b. PT. Dongin Prabhawa’s CPO mill extension work is in accordance with the Plantation Operational Permit(IUP) in 2015, that is, capacity of 120 tons/hour. Currently the installed capacity is 50 tons/hour and will be 100 tons/hour after the construction.
c. In terms of indigenous traditions, on September 2016, PT Dongin Prabhawa carried out the traditional event (ritual) at the CPO mill site based on the traditions of the Marind tribe. Through this traditional ritual, the company’s use of this land as CPO mill site became valid under the customary law.
d. Previously, at the time of land compensation, there was an agreement between the company and the community that the community would not interfere with the company’s operations. Disrupting factory operations is also not allowed under customary law.
1. The result of the final consultation held at the PT. Dongin Prabhawa between the company and several members of Dinaulik clan is as below:
a. The company did not agree to pay the compensation requested by several members of Dinaulik clan because the CPO mill extension work is in accordance with the applicable procedures and there was a prior agreement that the community would not interfere with the company’s operations.
b. In the consultation several members of Dinaulik acknowleged that what actually happened was a conflict of interest within the Dinaulik clan internally.
c. Hence, In a good faith, PT. Dongin Prabhawa provided support in facilitating the resolution of internal problems of Dinaulik clan and straightening out problems about the CPO mill area (related to the extension) located in the former customary lands of the Dinaulik dan Walinaulik clans.
2. Based on the result of that consultation, the matter is not because of problems with the company but with interests within the clan. From the PT Dongin Prabhawa’s perspective, the complaint has been resolved and it is suggested that the internal problems of Dinaulik clan should be resolved by themselves.
